When you have a friend or family member who has been arrested, it can be difficult to know how to help. One of the biggest ways you can provide support is by knowing about the arrest process: How it works, and what will happen once the arrest has been made. In today’s blog post, we’ll take a look at what your friend will experience during the arrest, and the next steps you can take to help them.

When Arrests Happen

It is important to understand that arrests can happen at any time. They don’t always occur at the scene of an alleged crime. In fact, they usually occur after the police have spent time investigating a reported crime. In these situations, a police officer will have investigated a crime, gathered evidence, and will obtain an arrest warrant from a judge. They must prove they have enough evidence to substantiate an arrest before the judge will grant the warrant. Once they warrant has been granted, the police officer will make the arrest. This can happen at home, work, or while a person is out and about. Of course, in some situations, arrests happen at the scene of a crime – such as after a person is pulled over for a DUI.

Arrest Process

When the police have an arrest warrant, or believe they have probable cause to make an arrest, the person accused of a crime will be handcuffed and brought to the nearest jail. Here, they will be booked in jail. This includes gathering and recording personal information, a background check run, a mug shot taken, a medical check, etc. Most people also believe that the police must read the arrested person the Miranda Rights at the time of arrest. This isn’t the case, however. The police are required to read these rights before questioning, but not at the time of arrest. Because of this, it is important for the arrested person to not say anything during the arrest, or after the arrest, without the advice of a lawyer.

The Arrest Process: How You Can Help

Obviously, there isn’t much you can do if you get the news that a loved one has been arrested. There are a few things you can do, however:

  • If the person in jail calls you, do not discuss their case. Phone calls in jails are recorded, and anything said during these calls will be used against your loved one in court.
  • Contact a lawyer, and discuss options. Many lawyers provide free consultations: take advantage of this to gain insight into what your friend is now facing.
  • Contact a bail bondsman to arrange bail for your friend. Sitting in jail is dangerous in many ways to your friend’s case – contact an agent to get them out quickly using bail bonds.
